1. Welcome and Acceptance of Terms
1.1 Scope of Agreement
These Terms of Service ("Terms") govern your access to and use of the website located at https://www.deyestore.com (the "Website"), any related mobile applications (the "App"), and all services, features, content, or applications offered by Cuiji Global Tech Limited (a company incorporated in Hong Kong) (collectively referred to as the "Platform" or "Services"). The Platform is operated as a marketplace intermediary. The Platform encompasses the Website, the App, and any other digital interfaces through which the Services are accessed.
1.2 Contracting Parties
In these Terms, "we", "us", or "our" refers to Cuiji Global Tech Limited, and "you" or "your" refers to you, the user of our Services (including, without limitation, browsers, vendors, customers, merchants, and/or contributors of content).
1.3 Binding Agreement
By downloading, installing, accessing, or using the Platform on any computer, mobile phone, tablet, console, or other device, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately cease all access to and use of the Platform.
1.4 Platform Role and Marketplace Model
DeyeStore operates as a marketplace platform and is not a seller of goods or services. We provide the Website, App, and related digital infrastructure that enables independent third-party merchants (“Merchants”) to offer goods and services to users.
(a) Merchants are independent sellers. Each purchase transaction on the Platform is a contract directly between you and the relevant Merchant. We are not a party to such contracts and are not responsible for the quality, safety, legality, or delivery of goods or services provided by Merchants.
(b) Merchant information. We publicly display Merchant information, including business name, registration details, and contact information, to enable you to identify and communicate with the relevant Merchant.
(c) Payment flow. Payments for goods and services are made directly to Merchants through the payment mechanisms available on the Platform. We do not collect payment on behalf of Merchants as sellers.
2. Global Eligibility and Account Management
2.1 Age Restriction
The Platform is intended for global users. By using the Platform, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction). If you are under the legal age of majority, you may only use the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
2.2 Account Registration
To access certain features of the Platform or place an order, you may be required to register for an account. You agree to:
· Provide accurate, current, and complete information during registration.
· Maintain and promptly update your account details to keep them accurate.
· Safeguard the confidentiality of your account password and login credentials.
· Accept responsibility for all activities that occur under your account.
2.3 Account Suspension and Termination
We reserve the right, in our sole discretion, to suspend, disable, or terminate your account with reasonable advance notice (except in cases of serious violations, fraudulent conduct, or illegal activity requiring immediate action) if we suspect that you have provided false information, violated these Terms, or engaged in fraudulent or illegal conduct.
3. Web and App Mobile Specific Provisions
3.1 App Stores Terms Hierarchy
If you downloaded our App from a third-party platform such as the Apple App Store or Google Play Store (each an "App Provider"), you acknowledge and agree that:
· These Terms are concluded between you and us only, not with the App Provider.
· Your use of the App must comply with the App Provider’s then-current Terms of Service or Usage Rules.
· The App Provider has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
3.2 Mobile Device Permissions
To provide the full functionality of the App, the App may require permissions to access certain features of your device, such as push notifications, camera, photo library, or location services. By enabling these features, you grant us permission to access them in accordance with our Privacy Policy. You can manage these permissions at any time through your device’s settings.
4. User Obligations and Prohibited Conduct
You agree to use the Platform only for lawful purposes. You are strictly prohibited from using the Platform (including both Web and App interfaces) in any manner that:

5. Shopify Ecosystem and Third-Party Links
5.1 Infrastructure Disclosure
Our online store and e-commerce functionalities are powered by Shopify Inc., combined with our independently developed integrations. Shopify provides us with the online e-commerce platform that allows us to support the marketplace infrastructure through which independent Merchants offer their goods and services to users of the Platform.
5.2 Third-Party Integrations
The Platform integrates with various third-party services, including but not limited to payment gateways (e.g., PayPal, Stripe, credit card processors) and logistics providers. You acknowledge that your interactions with these third-party services are governed by their respective terms and privacy policies. We are not responsible for the performance, availability, or security of any third-party services.
In addition to the above, the Platform enables independent third-party Merchants to offer goods and services to you through the Website, App, and other digital channels. Merchants are independent sellers and are not employees, agents, or representatives of us. Your purchases from Merchants constitute contracts directly between you and the relevant Merchant, governed by the Merchant’s own terms and applicable consumer law.
6. Content Standards, Ownership, and Licensing
6.1 User-Generated Content
If you submit, post, or upload any content to the Platform (such as product reviews, comments, feedback, or photos), you retain ownership of any intellectual property rights you hold in that content.
6.2 License Grant to Us
By submitting content, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display such content solely for the purposes of: (i) operating and improving the Platform; (ii) facilitating transactions between you and Merchants; and (iii) promoting the Platform, with your prior consent where required by applicable law.
6.3 Content Moderation
We reserve the right (but have no obligation) to monitor, edit, or remove any user content that we determine, in our sole discretion, to be unlawful, offensive, defamatory, obscene, or in violation of these Terms or any third-party intellectual property rights.
7. Disclaimer of Warranties
IMPORTANT NOTICE: Please read this section carefully as it limits our liability to the maximum extent permitted by applicable law.
"As-Is" Basis: The Platform, its content, and all products and services provided through it are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.
No Guarantees: Cuiji Global Tech Limited makes no representations or warranties that:
1. The Platform will be uninterrupted, timely, secure, or error-free;
2. The quality of any products, services, information, or other material purchased or obtained by you will meet your expectations;
3. The servers or files available for downloading from the Platform are free of viruses or other harmful components.
Notwithstanding the above, nothing in this section limits any statutory implied terms or consumer protection rights that cannot be excluded or limited under applicable law in your jurisdiction, including but not limited to rights under EU consumer law, Hong Kong consumer protection ordinances, and equivalent mandatory law.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Cuiji Global Tech Limited nor its directors, officers, employees, affiliates, agents, contractors, or interns, be liable for any:
· Indirect, incidental, punitive, special, or consequential damages;
· Loss of profits, loss of revenue, loss of savings, or loss of data;
· Under any contract, tort (including negligence), strict liability, or other legal theory arising from your use of the Platform or any products procured using the Platform.
· In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.
For the avoidance of doubt, as a marketplace platform operator, we are not liable for the quality, safety, fitness for purpose, or delivery of goods or services provided by Merchants. Any claims relating to goods or services should be directed to the relevant Merchant.
9. Indemnification
You agree to defend, indemnify, and hold harmless Cuiji Global Tech Limited and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, and service providers from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of:
· Your breach of these Terms or the documents they incorporate by reference;
· Your violation of any applicable law or the rights of a third party;
· Any content you submit or activity performed through your account on the Web or App.
10. Termination
10.1 Right to Terminate
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
10.2 Effect of Termination
We may terminate or suspend your access to the entire Platform or any part thereof immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.
11. Governing Law and Jurisdiction
11.1 Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by, construed, and enforced in accordance with the laws of Hong Kong, without regard to its conflict of law principles.
11.2 Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, invalidity, breach, or termination thereof, shall be submitted to the exclusive jurisdiction of the competent courts in Hong Kong.
11.3 Global Consumer Protection Safeguard
To the extent that local mandatory consumer protection laws in your country of residence provide you with rights that cannot be waived or modified by contract, those laws shall apply to the extent required by law.
12. Changes to Terms of Service
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website and within the App. It is your responsibility to check our Platform periodically for changes. Your continued use of or access to our Platform or the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
